xtAudio Affiliate Program Terms

These terms govern the xtAudio affiliate program: who can join, how the sales you refer are recorded, how much you earn, when and how we pay you, and the rules you must follow when promoting xtAudio. By submitting your application, you accept them.

The Privacy Policy explains how we handle your data and the data of people who visit the site through your link. Purchases of xtAudio are governed by the Sale and License Terms and the Refund Policy.

1. Who we are

The program is run by Xtrategika, a business name used by Rafael Omar Mojica García, a sole proprietor based in Irving, Texas, United States (“Xtrategika,” “we,” “us”). In these terms, “you” means the affiliate.

XTRATEGIKA 360 SRL (Santo Domingo, Dominican Republic) is a related but separate company, and it doesn’t take part in this program.

2. How to join

  • Requirements:
    • you are at least 18;
    • you have an account on xtrategika.com (if you don’t, the application form creates one);
    • if you apply on behalf of a company, you are authorized to do so;
    • you are not located in, or ordinarily resident in, a country or region subject to comprehensive U.S. embargoes or sanctions (as determined by the U.S. Treasury’s OFAC), and you are not on a U.S. government restricted-party list;
    • you don’t reside in the European Union, the European Economic Area, the United Kingdom, Monaco or the Isle of Man. For now the program isn’t available there, just like sales (section 15 of the Sale and License Terms).
  • Application: you submit it with the form on the program page (https://xtrategika.com/xtaudio/afiliados/) or from My Account → Affiliates. We ask for your name, your email address, your country, your websites or social media profiles, how you plan to promote xtAudio and your payout method. If you like, you can suggest the code for your link.
  • Approval:
    • we review every application and reply by email within 5 business days;
    • we may ask you for more information;
    • we approve or reject applications at our discretion, and we don’t always explain why;
    • you don’t earn commissions before we approve you.
  • You may have only one affiliate account per person or company.
  • The information you give us must be true. Keep it up to date in My Account → Affiliates.

3. Your relationship with Xtrategika

  • You are an independent contractor. This program doesn’t make you an employee, agent, partner, franchisee or representative of Xtrategika, and it doesn’t create a partnership or joint venture.
  • You may not speak or sign on our behalf, promise anything about xtAudio that our sales page doesn’t say, provide support as if you were us, or charge buyers.
  • You decide how, when and where you promote xtAudio, within these terms. Your costs (advertising, tools, time) are your own.
  • The program isn’t exclusive: you may promote other products, including competitors’, and we may have other affiliates.
  • Use of our brands: while you take part, you may use the names “xtAudio” and “Xtrategika,” and the logos, screenshots and copy we give you, only to promote xtAudio under these terms. Don’t modify them or use them in a way that suggests you are us. This permission ends when you leave the program.

4. Your link and how a sale is recorded

  • Your link: when we approve you, we give you your code (the one you suggested, if it’s available and we accept it). Your link is https://xtrategika.com/xtaudio/?ref=YOURCODE. Any other page of xtrategika.com with ?ref=YOURCODE at the end also works, such as the English page: https://xtrategika.com/en/xtaudio/?ref=YOURCODE. My Account → Affiliates has your link and a link builder.
  • The cookie: when someone visits through your link, we save a cookie named xt_ref in their browser with your code and the date. It lasts 60 days from that click, and each new click on your link renews it.
  • When the sale is yours: if that person buys an xtAudio license within those 60 days, from the same browser, the sale is recorded under your name.
  • Last click wins: if they later click another affiliate’s link, the sale goes to that other affiliate. Coming back to the site without an affiliate link doesn’t replace yours.
  • Limits: we can’t record the sale if the buyer deletes or blocks cookies, closes a private browsing window, or buys from another device or browser. We don’t track people across devices.
  • If a sale of yours wasn’t recorded: if a buyer tells you they came through you and the sale doesn’t appear in your dashboard, write to us within 30 days of the purchase. If we can confirm it and the sale isn’t recorded under another affiliate, we may assign it to you.
  • The buyer gets no discount for using your link: they pay the price on the sales page.
  • For now we don’t sell in the EU, the EEA, the United Kingdom, Monaco or the Isle of Man: checkout doesn’t accept billing addresses in those countries. People who arrive through your link from there can’t buy.

5. Your commission

  • How much: 30% of what the buyer pays for the license, excluding taxes (such as sales tax or VAT), unless we agree in writing on a different rate with you. If the buyer pays less because of a discount from us, the commission is calculated on what they paid.
  • On “Done for you”: the commission is only on the license part (section 7 of the Sale and License Terms), which is USD 149 as a founder or USD 199 after the offer closes. The service part doesn’t earn a commission.

  • Commissions are calculated in US dollars (USD) and rounded to the cent.
  • You earn a commission on every sale recorded under your name that complies with these terms, with no limit on the number of sales.
  • We may change the rate or the products in the program for future sales, with prior notice (section 13). A change never affects commissions on sales already made.

6. Sales that don’t earn a commission

There is no commission, or it is voided if it was already recorded, in these cases:

  • Self-referrals: purchases made through your own link for yourself or your company, or with an account, card or billing details that are yours or that you control. If you manage client sites, you earn the commission when the client buys with their own account and payment method, not when you buy on their behalf.
  • Fraudulent or unpaid orders: orders paid with stolen cards or without the cardholder’s authorization, and orders that are cancelled, failed or whose payment is reversed.
  • Refunds and chargebacks (section 9).
  • Licenses that aren’t sold: those we issue by hand, for testing, as a courtesy or as a replacement.
  • Sales obtained through prohibited practices (section 7):
    • coupon, deal, cashback or rewards sites without our written approval;
    • using our brands as keywords in ads;
    • using our brands in domains or profiles;
    • spam or unsolicited messages;
    • misleading claims;
    • incentivized or fake clicks, or any way of forcing the cookie.
  • Sales that come from content without the required disclosure in section 8, if you don’t fix it within 10 days after we ask you to.

7. How you may promote xtAudio

You may:

  • publish reviews, tutorials, videos, livestreams, comparisons and recommendations on your sites, social media, channels and newsletters;
  • recommend it to your clients and contacts;
  • email your own list of subscribers, if they agreed to receive your emails, in compliance with the law (in the US, the CAN-SPAM Act);
  • advertise on generic keywords, such as “WordPress audio plugin,” without using our brands;
  • offer a bonus of your own (for example, a guide or a consultation with you), if you deliver it yourself, describe it honestly and make clear that it is yours and not Xtrategika’s.

You may not:

  • Use our brands as keywords in ads: bid on Google Ads, Microsoft Ads, Meta or other platforms on keywords that include “xtAudio,” “Xtrategika,” or variations or misspellings of those names. You also may not use them in an ad’s headline, text, display URL or advertiser name.
  • Use our brands in domains or profiles: register or use domains, subdomains, social media profiles, or page, channel or app names that contain “xtAudio” or “Xtrategika,” or anything confusingly similar. You may name the product in your content and in a page’s address (for example, yoursite.com/xtaudio-review).
  • Use coupon and deal sites: post your link on coupon, deal, cashback or rewards sites without our written approval. xtAudio has no coupons: don’t advertise discounts that don’t exist.
  • Give the buyer money: pass part of your commission back to the buyer or give them a discount for buying through your link. The bonus of your own allowed above is fine.
  • Send spam: send bulk or unsolicited emails, text messages, WhatsApp messages, direct messages or comments; post your link in groups, forums or communities whose rules don’t allow it; use purchased lists or bots.
  • Make misleading claims: say anything about xtAudio that isn’t true or that our sales page doesn’t say. For example:
    • promising results, such as more traffic, more sales or better search rankings;
    • saying it is free or has no usage costs without making clear that the buyer needs their own Google Gemini or OpenAI account and pays them for AI usage;
    • presenting founder prices as current after the offer closes, or making up urgency or scarcity;
    • posting fake reviews or testimonials, or saying you use xtAudio if you haven’t;
    • presenting yourself as Xtrategika, as its support or as an official reseller.
  • Generate incentivized or fake clicks:
    • paying or rewarding anyone for clicking or buying, except for the bonus of your own allowed above;
    • using bots or click exchanges;
    • using pop-ups, pop-unders, iframes or hidden pages that open your link without the person clicking it;
    • using extensions or software that replace links;
    • using any technique that sets the cookie without a real visit (cookie stuffing).
  • Promote on inappropriate sites: with illegal, hateful, violent or adult content, or content that infringes other people’s rights.

How to talk about these topics. If you mention them, use the same conditions as our sales page:

  • Guarantee: put the condition next to the word “guarantee.” If xtAudio doesn’t work on the buyer’s site and we can’t fix it within 7 business days, we refund 100%. If they haven’t activated the license on any site yet, we also refund 100%, without asking for a reason. Either way, they must write to us within 30 days of purchase. It doesn’t cover a change of mind after activating the license, or the AI provider’s charges.
  • One-time payment: next to “one-time payment,” make clear that you need your own Google Gemini account (it has a free tier with limits) or OpenAI account, and that you pay them for AI usage.
  • Lifetime updates: add “for as long as Xtrategika develops and distributes xtAudio.”
  • Prices: link to the sales page, which always shows current prices. When the founder offer closes, update or remove founder prices within 14 days in the content you can edit. In content you can’t edit, such as a video already published, add to the description that prices may have changed.

We may review your content and ask you to correct something. Correct it within 10 days. If the content is misleading or illegal, we may pause your link in the meantime.

8. Required disclosure: say that you earn a commission

US law requires you to say clearly that you earn a commission when you recommend xtAudio with your link (the FTC’s Guides Concerning the Use of Endorsements and Testimonials in Advertising, 16 CFR Part 255). We require it from all affiliates, wherever they live.

  • Where: close to your recommendation and before the link, in a place people can see without clicking “see more.” Putting it only in a footer, on an “About” page or in your profile isn’t enough.
  • How: in plain words. “Affiliate link” or “#affiliate” on their own may not be understood.
  • In which language: the same language as your recommendation.
  • In videos and livestreams: say it out loud and also show it in writing, on screen or in the description. In livestreams, repeat it from time to time, because people join halfway through.
  • In short posts (Instagram, TikTok, X): at the beginning of the text. If the platform has a tool to label paid or sponsored content, use it in addition to the disclosure.
  • If we gave you anything else, such as a free license, you must say so too.
  • Only recommend what you really think. If you say you use xtAudio, you must have used it.

Examples you can copy:

  • In Spanish: “Si compras xtAudio con mi enlace, Xtrategika me paga una comisión. A ti no te cuesta más.”
  • In English: “If you buy xtAudio through my link, Xtrategika pays me a commission. It doesn’t cost you anything extra.”
  • In a video or livestream: “Heads-up: the xtAudio link in the description is an affiliate link. If you buy through it, I earn a commission.”

9. Pending, available, voided and deducted commissions

  • Pending: each commission stays pending for 30 days from when the order’s payment is confirmed, which is the period for requesting a refund. If a refund request or a payment dispute on the order is open when that period ends, it stays pending until it is resolved.
  • Available: after that period, the commission becomes available and goes into the next monthly payment (section 10).
  • Voided: the commission is voided in these cases:
    • the order or the license is refunded, including the license part of “Done for you”;
    • a card dispute or chargeback is decided in the cardholder’s favor;
    • we revoke the buyer’s license for breaching the Sale and License Terms (for example, sharing or reselling the key);
    • any of the cases in section 6 applies.
  • If only the service part of “Done for you” is refunded, your commission doesn’t change. If we refund only part of the license price without revoking it, the commission is recalculated on what the buyer ended up paying.
  • If we already paid it: sometimes a refund or chargeback arrives after we have paid you the commission. For example, a bank chargeback months later, or a guarantee refund approved after day 30. In that case:
    • we deduct that commission from your next payment;
    • if your balance becomes negative, it is offset against your future commissions;
    • we only ask you to pay the money back if the refund or chargeback comes from fraud or from a breach of these terms.
  • If we win a dispute that had voided your commission, we restore it.
  • Your dashboard shows the status of each commission and the date it becomes available.

10. Payments

  • When: once a month, within the first 15 days, we pay you the balance that was available on the last day of the previous month.
  • How: by PayPal or by Wise. You choose in My Account → Affiliates → Payout settings:
    • for PayPal, we need your PayPal account’s email address;
    • for Wise, your Wise account’s email address or the details of the bank account where you want to receive the money.
  • Minimum: USD 50. If your available balance is lower, it carries over to the next month and accumulates. It doesn’t expire while your affiliate account is active.
  • Currency: we pay in US dollars (USD). If your account receives in another currency, your provider converts it at its own exchange rate.
  • Transfer costs:
    • we pay what PayPal or Wise charges us to send you the payment;
    • whatever your provider or bank charges you to receive, convert or withdraw the money is your cost;
    • if you ask to be paid to a US-dollar account outside the US by international wire (Swift), its cost is deducted from the payment.
  • Before your first payment we need your payout details and your tax form (section 11). Until we have them, we keep your balance: it isn’t lost.
  • Receipt: every time we pay you, we email you the amount, the method and the reference. The payment also appears in your payment history.
  • Incorrect details: check your payout details carefully. If a payment is returned because the details were wrong, we resend it in the next monthly payment once you correct them. We are not responsible for a payment correctly sent to the details you gave us.
  • Errors: if you think there is an error in a commission or a payment, write to us within 60 days. If we overpay you by mistake, we deduct it from your next payments.
  • Inactive accounts: if 12 months go by with no recorded sales and without you logging in to your dashboard, we may close your affiliate account. We’ll tell you by email 30 days in advance. When we close it, we pay you the available balance, even if it is under USD 50.
  • If we can’t pay you because you never gave us valid payout details or your tax form, we keep the balance and handle it as the law requires, for example under Texas unclaimed property rules.

11. Taxes

  • You are responsible for reporting and paying the taxes on your commissions wherever they apply to you.
  • Before your first payment, you must give us one of these forms from the IRS (the US tax agency):
    • Form W-9, if you are a US person: a US citizen or resident, or a US company;
    • Form W-8BEN, if you are an individual who is not a US person, or W-8BEN-E, if you are a company outside the US.
  • We’ll tell you by email how to send it securely. Don’t upload it to the dashboard or send it through any other channel.
  • If your details or situation change (for example, you move to the US), send us a new form within 30 days.
  • We file Form 1099-NEC with the IRS, with a copy for you, when the law requires it.
  • If the law requires us to withhold taxes from a payment, we withhold them and tell you. One example is US backup withholding, which applies when a valid taxpayer identification number is missing.
  • The commission amount is the total we pay you. If you must charge or report a tax on it in your country, such as VAT, it is included in that amount. If the law of your country requires you to issue us an invoice, send it to us.

12. Buyers’ data and confidentiality

  • Your dashboard shows only the date, product, amount and status of each sale recorded under your name. We never give you buyers’ names, email addresses or other details.
  • If a buyer tells you they bought, don’t ask them for their purchase details or license key, and don’t try to access their account.
  • Program information that isn’t public, such as your statistics or news we share with you before announcing it, is confidential: don’t publish it.
  • If you collect data from your audience, such as your email list, you are responsible for it and for complying with the privacy laws that apply to you.
  • Section 15 of the Privacy Policy explains what data about you we keep and for how long.

13. Changes to the program

  • We may change these terms, the commission or the products in the program. We’ll tell you by email and in your dashboard at least 15 days before the change takes effect. If the change benefits you or the law requires it, it may apply sooner.
  • Changes apply to sales made from their effective date. Commissions on earlier sales follow the rules that were in effect when the sale was made.
  • If you don’t agree with a change, you can leave the program (section 14). If you keep taking part after its effective date, you accept it.

14. Leaving and termination

  • You may leave whenever you want, from My Account → Affiliates or by writing to us.
  • We may end your participation:
    • by telling you by email 15 days in advance, for any reason;
    • immediately, if you breach these terms. If the breach can be fixed and it isn’t fraud, we’ll first tell you and give you 10 days to fix it. While we review it, we may pause your link.
  • We may close the program by telling you 30 days in advance.
  • What happens to your commissions:
    • from the date you leave, your link stops recording sales;
    • commissions on sales recorded before that date follow the rules in section 9, and we pay them when they become available, even if the total is under USD 50;
    • if we end your participation for a breach, we void the commissions related to it and pay you the rest;
    • if the breach is fraud, we may withhold unpaid commissions to cover the damage (for example, refunds, chargebacks and their fees), and we pay you whatever is left.
  • When you leave, stop using our logos and materials, and remove your affiliate link from your content within 30 days.
  • Sections 9 to 12 and 15 to 17 remain in effect after you leave, as far as needed.

15. Warranties and liability

  • The program is provided “as is.” We don’t guarantee sales or income. We also don’t guarantee that click and sale tracking will always work (it depends, among other things, on the cookies in the buyer’s browser) or that the site will be available without interruptions.
  • Limit of liability: to the extent permitted by law:
    • our total liability to you for any claim about the program is limited to the total commissions you earned in the 12 months before the claim. This doesn’t reduce the commissions we already owe you;
    • we are not liable for indirect, incidental, special or consequential damages, such as lost profits or business.
  • Your responsibility: you are responsible for your content, your ads and what you say about xtAudio. If your breach of these terms or of the law causes us a claim, a fine or an expense, including reasonable attorneys’ fees, you cover it.
  • What isn’t limited: these terms don’t exclude or limit liability that the law doesn’t allow to be excluded, such as liability for fraud, willful misconduct or gross negligence.

16. Governing law and disputes

  • These terms are governed by the laws of the State of Texas and the applicable federal laws of the United States, without regard to their conflict-of-law rules.
  • Before any claim, write to info@xtrategika.com: we’ll try to resolve it within 30 days.
  • If it isn’t resolved, the competent courts are the state courts of Dallas County, Texas, or, if it has subject-matter jurisdiction, the United States District Court for the Northern District of Texas (Dallas Division). Both parties consent to the jurisdiction of those courts. Either party may also go to a small-claims court.

17. Language and other provisions

  • These terms are published in Spanish and English, with equal value. If the versions differ, the version in the language you were using on the site when you submitted your application prevails.
  • You may not transfer your affiliate account or your commissions to anyone else without our permission.
  • We send notices to the email address of your xtrategika.com account.
  • If a court finds a clause invalid, the rest stays in effect.
  • Not exercising a right at a given time doesn’t mean we waive it.
